6. How to request a record
- Use Form 2 of the PAIA Regulations and send it to the Information Officer at
the address above.
- Give enough detail to identify the record, and your contact details.
- State the right you are trying to exercise and why the record is needed for
it.
- Say how you want to receive the record.
- Pay the prescribed request fee where one applies. Access fees for reproduction,
search and preparation are charged at the rates in the PAIA Regulations, and we
confirm the amount before any work starts.
- We decide inside 30 days and tell you in writing. The period extends by a
further 30 days where the request covers a large number of records.
A request for your own personal information carries no request fee.
7. When access is refused
The Act sets out the grounds. They include the privacy of a third party,
commercial information of a third party, legal privilege, and records held for
legal proceedings. We also rely on section 67 where it applies, which protects a
journalistic source and unpublished material gathered for publication. A refusal is
given in writing with the reasons and the provisions relied on.
8. Remedies
There is no internal appeal in a private body. If we refuse, you may complain to
the Information Regulator or apply to a court within 180 days.
